The town’s lawyer, Gregg J. Corbo weighs in on the Citizens petition to move the Disc Golf course to another location.

Gregg J. Corbo, the town council for the Town of Belchertown, weighed in on the citizen’s petition to move the Disc Golf Course from its current proposed location of Constantino Recreation Area to “another” area. According to Attorney Corbo, “the petition suffers a particular problem in that it proposes an action that appears to be beyond the authority of Town Meeting to take.” He further states that “with respect to the use of Town property, in this particular instance, the property at issue is subject to the jurisdiction of the Parks and Recreation Department. They have custody and control of the land, and they have the statutory authority to make decisions with respect to how that land is used.”  Once the land has been designated to a particular use or department it becomes under the control of that department and the Executive branch of government, in this case, the Select Board. With this latest news from Attorney Corbo and the Select Board and the anticipated Wetlands Delineation days away from being completed,  we are expecting to have the layout approved on the 26th.
 
With some luck, on the 27th we will be out there and clearing the brush to get this course going!
